The Province of B.C. continues to regulate the aquaculture industry in B.C. until December 18, 2010. At that time, Fisheries and Oceans Canada (DFO) will assume federal regulatory jurisdiction.

DFO has initiated the process of drafting a regulation under the Fisheries Act for aquaculture in B.C. It is anticipated that the pre-publication (draft) of the new regulation will be posted on the Canada Gazette in June 2010. A comment period will provide the public with an opportunity to review and comment on the draft regulation.

It is anticipated that the new aquaculture regulation for both finfish and shellfish will lead to a more streamlined management regime with improved environmental protection measures.

It should be noted that DFO will be assuming regulatory jurisdiction for the aquaculture industry in B.C. in terms of conservation and protection of fish and fish habitat and the management of the aquaculture industry. The Provincial government will continue to be responsible for leasing the seabed where operations take place in the marine environment.
